Individualized Assessment, as referenced in § 42-38(a) means a process by which a person considers all factors relevant to an individual’s conviction history from the previous three (3) years. An individualized assessment is not required for convictions that are more than three
Individualized Assessment, means a written determination made by the Employer that there is or is not an effective link between specific aspects of the Applicant’s Criminal History and the risks inherent in the job duties and responsibilities of the employment position. At the minimum, the Employer must consider factors identified in the EEOC Enforcement Guidance.

Examples of Individualized Assessment, in a sentence

  • An extension of insurance benefits up to two months may be approved based on the results of an Individualized Assessment performed under the provision of the ADA, as amended.

  • At six (6) months, twelve (12) months and twenty-two (22) months after the Effective Date of this Agreement, copies of Individualized Assessment documentation referenced in Section VI.G of this Agreement.

  • The Individualized Assessment Standard Operating Procedures shall not be implemented by DFCS without OCR’s approval, which shall not be unreasonably withheld.

  • In conducting an Individualized Assessment of a specific applicant or employee, the employer must consider all relevant information, including, but not limited to, input from the individual in question, the individual’s experience performing the position in question or a similar position, the opinions of physicians, psychologists and other professionals who have expertise with respect to the condition involved, and/or direct knowledge about the individual’s ability to perform.

  • Upon Request by the applicant in situations where the applicant is rejected, the applicant has 10-14 days to request an Individualized Assessment from the date they receive the adverse action letter.

  • Within thirty (30) calendar days of receiving the revised Transportation Policy, Individualized Assessment Tool, and Individualized Assessment Tool Standard Operating Procedures, OCR will review them.

  • Any Psychological Evaluation that is conducted on this basis must remain strictly limited to the determination by Individualized Assessment of whether the individual, with or without a Reasonable Accommodation, (a) is able to perform the Essential Functions of the position in question or (b) poses a Direct Threat.
