Where the Scottish Ministers have appointed an Incoming Operator, the Operator must cooperate with the Scottish Ministers and the Incoming Operator to ensure smooth handover and uninterrupted provision of the Services.
The Operator will, within three months after the Commencement Date, deliver to Scottish Ministers a Handover Assistance Plan which sets out the Operator’s proposed methodology for achieving an orderly transition of Services from the Operator to the Scottish Ministers and/or its proposed Incoming Operator on the expiry or termination of this Contract and which complies with the requirements set out Clause 16.6 below.
