Inclusion Rate definition

Inclusion Rate means the percentage of interest income received by the Noteholder on securities acquisition loans which is not excluded from its gross income for Federal income tax purposes pursuant to Section 133 of the Code, or any successor thereto. For purposes of calculations hereunder, the original Inclusion Rate expressed as a decimal is .50.
Inclusion Rate means the percentage of interest income received or accrued by an entity which is a Qualified Holder on securities acquisition loans which may not be excluded from such entity's Federal Gross Income. Without limiting the foregoing, if Section 133 of the Code is repealed the Inclusion Rate shall be 100%.

Examples of Inclusion Rate in a sentence

  • If on January 1, 1991 the Inclusion Rate is not 50% or if the Federal Tax Rate in effect on that date is different than the Federal Tax Rate in effect on the date hereof, the interest rate on the Notes shall be adjusted first to the Qualified Tax-Exempt Rate and then shall be immediately further adjusted pursuant to the principles of paragraph 7D; such adjusted interest rate shall also be subject to further adjustments pursuant to this paragraph 7.

  • If on January 1, 1991 the Inclusion Rate is 50% and the Federal Tax Rate then in effect is equal to the Federal Tax Rate on the date hereof, the interest rate on the Notes held by each Qualified Holder shall be automatically adjusted, effective on January 1, 1991, to the Qualified Tax-Exempt Rate until further adjusted pursuant to paragraph 7.

  • Inflation rate means that term as defined in section 34d.

  • Extension Rate means, for each distribution date following a Failed Remarketing with respect to the class A-5 notes if such notes are then in foreign exchange mode, the rate of interest payable to the related currency Swap Counterparty, generally not to exceed three-month LIBOR plus 0.75%, unless the remarketing agent, in consultation with the administrator, determine that market conditions or some other benefit to the trust requires a higher rate; provided that in each case the Rating Agency Condition is satisfied.

  • Calculation Rate For each Distribution Date, in the case of the Class A and Class B Interests, the product of (i) 10 and (ii) the weighted average rate of the outstanding Class A and Class B Interests, treating each Class A Interest as capped at zero or reduced by a fixed percentage of 100% of the interest accruing on such Class.

  • CPI Daily Inflation Reference Index means (A) in relation to the first day of any given month, the CPI Monthly Reference Index of the third month preceding such month, and (B) in relation to a day (D) (other than the first day) in any given month (M), the linear interpolation of the CPI Monthly Reference Index pertaining respectively to the third month preceding such month (M - 3) and the second month preceding such month (M - 2) calculated in accordance with the following formula:

  • Capitalization Rate means 7.00%.
