Cost of Relocation means the entire amount to be paid for Utility Work that is properly attributable to the Relocation after deducting from that amount the cost of any Incidental Utility Work, Betterments, Excluded Environmental Work, Depreciation Value, and/or Salvage Value, as applicable.
Regardless of which party is responsible for performing the Utility Work, the Contractor will be solely responsible for performing any Incidental Utility Work.
Incidental Utility Work includes all In-Place/Out-of-Service Work and Protection In-Place of Facilities.
Each Party shall contractually require its Contractors to coordinate and cooperate with the other Party and with other Contractors involved in Utility Work and Incidental Utility Work.
The Parties each agree to coordinate and cooperate with one another and with their respective Contractors in order to ensure that Utility Work, Incidental Utility Work, and any Excluded Environmental Work are performed promptly, and in close coordination with the Project implementation.
The Parties shall at all times in the performance of Utility Work, Incidental Utility Work and Excluded Environmental Work strictly adhere to, and comply with, all other applicable federal and state and local laws and their implementing regulations as each currently exists and may hereafter be amended.
Unless otherwise requested by the Utility Owner, no Task Orders are required, nor will Task Orders be issued, for Incidental Utility Work, and Contractor’s responsibility for the same shall not be contingent upon the issuance of a Task Order.
The Authority has entered or intends to enter into a Cooperative Agreement with each Third Party known to be impacted by the Project, other than Excluded Third Parties; provided however, that the Authority may, but is not required to, enter into Cooperative Agreements with Included Third Parties for which only Incidental Utility Work is anticipated.
Contractor shall not be entitled to an adjustment for increased costs of the Work resulting from, or for any extension of time for delays associated with, the performance of Incidental Utility Work by Contractor or any Utility Owner.
No increase or decrease in the Contract Price shall be made pursuant to this Section 49.1.10 on account of any change in the allocation of responsibility for Incidental Utility Work.
