Impugned Amount definition
Impugned Amount has the meaning given in clause 10.7.
Impugned Amount has the meaning given in clause 4.5; Non-Disclosure Agreement means the mutual non-disclosure agreement and exclusivity agreement between the Target and the Bidder dated 3 October 2005;
Impugned Amount means all or part of the payment required to be made under Clause 15.6 that is found by a court to: (a)be unlawful; or (b)involve a breach of directors' duties. Independent Expert means the independent expert engaged by Aquarius in accordance with ASIC Regulatory Guides 111 and 112.

Impugned Amount has the meaning given in clause 10.8. Independent Expert means the independent expert to be engaged by Target to express an opinion on whether the Scheme is in the best interests of the Target Shareholders.
