If reasonable under the circumstances, Tenant may provide an Imminent Threat Notice by telephone.
If (a) Landlord fails to take or commence to take (and diligently pursue to completion) the required action within five (5) days of receiving a Reminder Notice or within such shorter time as is reasonable given the totality of the circumstances after an Imminent Threat Notice, and (b) Tenant in good faith believes that it can perform such obligations, then Tenant may, subject to the terms of this Section 24, perform such obligations (but solely on its own behalf, and not as the agent of Landlord).
