IBM Programs definition
IBM Programs means the IBM 3rd Party Software specified on the Order Form, which are owned by IBM or an IBM supplier, and are copyrighted and licensed, not sold.
IBM Programs. , which means programs protected by IBM’s IP rights other than or in addition to IBMA’s IP rights which are marketed by IBM or its subsidiaries and which are licensed, authorised or otherwise provided to IBMA pursuant to the SLA (I will adopt the expression IBM Programs as defined in the SLA where relevant in my reasons);
Examples of IBM Programs in a sentence
Maintenance may, but need not be, provided if Licensee has modified the IBM Programs or if Customer or End User is in default of this Agreement.
Any license and intellectual property indemnification terms of Customer's other agreements with IBM (such as an IBM Customer Agreement) do not apply to IBM Programs licensed under this Agreement.
The rights and obligations set forth in this Section 6 remain in effect during the period the IBM Programs are licensed to Licensee, and for two years thereafter.
