Subject to clause 4.2, the schedules and any further practices and procedures agreed by the Parties, nothing in this Agreement may be construed as precluding HTAL from using, modifying or substituting such of its facilities for other of its facilities as reasonably required to provide the Service, provided that HTAL complies with the applicable Quality of Service Standards and technical specifications for Interconnection set out in the Technical and Operations Manual.
As at 30 June 2008, HTAL had total gross assets of A$2.7 billion.

During an emergency where continued supply of the Service may pose a significant threat to safety of persons, hazard to valuable Equipment or a significant threat to Network security, HTAL may refuse to provide or may suspend the provision of the Service until HTAL considers that the continued supply of the Service no longer poses a significant threat to the safety of persons, hazard to valuable Equipment or a significant threat to Network security.
HTAL must provide the Access Seeker with the Communication Information in respect of each Designated Communication.
