Producer shall bear all risk of loss or damage to the Approved Eligible Cattle prior to the point and time which the Processor takes the Hot Carcass Weight of the Approved Eligible Cattle.
Within three business days following the date which Processor takes the Hot Carcass Weight of the Approved Eligible Cattle, Processor will notify Buyer of the Hot Carcass Weight which shall be final and not subject to dispute by Producer.
Ownership and title to the Approved Eligible Cattle shall be transferred to Buyer immediately following such time as the Processor takes the Hot Carcass Weight of the Approved Eligible Cattle and reports the Hot Carcass Weight to Buyer.
Within three business days following Buyer’s receipt of the Hot Carcass Weight from Processor, Buyer shall issue payment to Producer which shall be made by [check delivered to Producer via U.S. mail delivered to the address specified in this [Agreement/Exhibit A]11 unless otherwise specified in the Shipping Declaration or otherwise agreed upon between Producer and Buyer.
