  • If Commercial Operation is not ultimately achieved, then HOBO will reconvey any Class A Units that were purchased by Evolve on behalf of HOBO using the second half of the Incentive Development Fee that HOBO excepted to receive at Commercial Operation and retain the remaining Class A Units.
