Owner grants to Hobbyist a nonexclusive, nontransferable license to use the Property (“Property”) identified below on the goods described herein as “Licensed Articles.” Hobbyist agrees that the nature and quality of products used in conjunction with Property shall conform to the design standards set by Owner below.
A “Non-Compensated Individual Hobbyist Developer” is an individual software developer (i.e., a person and not any corporation, partnership or other legal entity), including a developer of open source software, who receives no monetary payment or any other forms of consideration that can be valued monetarily for their creation of their Original Works.
For example, if Developer’s License Certificate indicates that Developer has obtained a “Non-Commercial Academic Single-User License” or a “Non- Commercial Hobbyist Single-User License”, then the individual Developer has obtained a single-user license for use by the single Developer to whom the License Certificate was issued for Non-Commercial Purpose(s).
Hobbyist products must be handmade by Hobbyist or repurposed from officially licensed goods.

Hobbyist acknowledges the ownership of the Property by Owner, and agrees that all use of the Property by Hobbyist shall inure to the benefit of and be on behalf of Owner.
The fact that You may be employed as a software developer by, and receive a salary from, a corporation, partnership or other legal entity, does not disqualify You from treatment as a “Non-Compensated Individual Hobbyist Developer” under this pledge, provided Your activities related to the creation of Your Original Work are performed during Your free time and outside the scope of Your employment.
Owner shall have the right to terminate this Agreement in the event of any affirmative act of insolvency by Hobbyist such as the sale, consolidation, merger, or upon breach of any of the provisions of this Agreement by Hobbyist.
Microsoft hereby covenants not to assert Microsoft Patents against each Non-Compensated Individual Hobbyist Developer (also referred to as “You”) for Your personal creation of an originally authored work (“Original Work”) and personal use of Your Original Work.
Upon termination of this Agreement, Hobbyist agrees to immediately discontinue all use of the Property and any term or device confusingly similar thereto, and to delete the same from its business name within 30 days of termination.
