Hearing Procedures to be followed in the event a Hearing is held shall be as follows: (i) Briefs may be submitted by the parties prior to the Hearing, setting forth their position in regard to the matters to be considered by the arbitrators. (ii) Interrogatories and requests for admissions or production of documents may be submitted by either party to the other and, subject to the jurisdiction of the arbitrators, shall be responded to by the other party. Each party shall have the right to request the arbitrators to issue subpoenas for documents in accordance with the Rules. (iii) A list of proposed witnesses to be presented by each party shall be delivered by it to the other party not less than twenty (20) business days prior to the commencement date set for the hearing by the arbitrators, and depositions of any such proposed witnesses of a party may be taken by the other party during the twenty (20) business day period, and the party proposing any witness shall assure the reasonable availability of each of its witnesses to the other party for deposition during such twenty (20) business day period. (iv) Each party shall be entitled, but not required, to make an opening statement at the Hearing, to present regular and rebuttal testimony, documents or other evidence, to cross-examine witnesses, and to make a closing argument. (v) The party requesting the Hearing shall begin the Hearing and, if it chooses to make an opening statement, shall address not only issues it raised but also any issues raised by the other party. The responding party, if it chooses to make an opening statement, also shall address issues raised by the parties. Thereafter, the presentation of regular and rebuttal testimony and documents, other evidence, and closing arguments shall proceed in the same sequence. Except for one representative of each party who shall be entitled to be present at all proceedings or when testifying, witnesses shall be excluded from the Hearing until closing arguments.
