For the avoidance of doubt, if any use or exploitation of Necessary Claims by any Licensee and/or its Affiliates infringes any claims of the patents which are necessarily infringed to implement and comply solely with the Formerly Adopted Specifications, such claims shall not be covered under the non-assertion provision of this IPR Policy and may be licensed to Licensee and/or its Affiliates under the terms of the HDMI Specification Adopter Agreement by HDMI Licensing Administrator.
Notwithstanding the foregoing, the copyrights in the Formerly Adopted Specifications shall be owned by each of the HDMI Founders and licensed by the HDMI Licensing Administrator under the terms of the HDMI Specification Adopter Agreement.
Such claims may be licensed to Licensee and/or its Affiliates under the terms of the HDMI Specification Adopter Agreement by HDMI Licensing Administrator.
Notwithstanding the foregoing, any information, trade secrets or know-how incorporated into a Formerly Adopted Specifications shall be owned by the HDMI Founders and licensed through HDMI Licensing Administrator under the terms and conditions of the HDMI Specification Adopter Agreement.
While the Promoters do not intend to supersede or in any way modify the terms of the HDMI Specification License (the “HDMI License”) or the DVI Specification License (the “DVI License”), it is Silicon Image’s intent to use its commercially reasonable efforts to ensure that the Specification and Silicon Image’s contributions to the UDI Specification provide interoperability and compatibility between a UDI Source and HDMI 1.x Sink.
