  • HCMC PC shall furnish, or cause to be furnished, to ADB, promptly after their preparation, such plans, design standards, specifications and work schedules, and any material modifications subsequently made therein, in such detail as ADB shall reasonably request.

  • Any action taken or any agreement entered into by HCMC PC pursuant to the authority conferred under Section 7.01 of this Loan Agreement shall be fully binding on the Borrower and shall have the same force and effect as if taken by the Borrower.

  • HCMC PC shall carry out the Project in accordance with plans, design standards, specifications, work schedules and construction methods acceptable to ADB.

  • Except as the Association may otherwise agree, each of EVN, HCMC PC and PC3 shall produce, for each of its fiscal years, beginning fiscal year 2006, funds from internal sources equivalent to not less than twenty-five percent (25%) of the annual average of its capital expenditures incurred or to be incurred for said year, the previous year and the following year.

  • The Borrower hereby designates HCMC PC as its agent for the purposes of taking any action or entering into any agreement required or permitted under Sections 3.02, 3.03 and 3.05 of this Loan Agreement and under Sections 6.01, 6.02 and 6.03 of the Loan Regulations.

  • The authority conferred on HCMC PC under Section 7.01 of this Loan Agreement may be revoked or modified by agreement between the Borrower and ADB.

  • HCMC PC shall through MAUR maintain records and accounts adequate to identify the items of expenditure financed out of the proceeds of the Loan, to disclose the use thereof in the Project, to record the progress of the Project (including the cost thereof) and to reflect, in accordance with consistently maintained sound accounting principles, its operations and financial condition.

  • The Borrower shall cause HCMC PC to make available, necessary budgetary and human resources to fully implement the EMP and the RP.

  • The Borrower shall make the proceeds of the Loan available to HCMC PC as a grant upon terms and conditions satisfactory to ADB and shall cause HCMC PC to apply such proceeds to the financing of expenditures on the SF Part of the Project in accordance with the provisions of this Loan Agreement and the Project Agreement.

  • The Borrower shall cause HCMC PC to ensure that the preparation, design, construction, implementation, operation and decommissioning of the Project and all Project facilities comply with (a) all applicable laws and regulations of the Borrower relating to environment, health and safety; (b) the Environmental Safeguards; and (c) all measures and requirements set forth in the IEE, the EMP, and any corrective or preventative actions set forth in a Safeguards Monitoring Report.
