The Parties expressly acknowledge that it is the intent of this Agreement that the Conservancy Lands will be administered so as to conserve and enhance the Habitat Values for all listed and unlisted Covered Species reasonably expected to be found in the Permit Area.
Subject to the requirements of Chapters IV and VI of the NBHCP, Mitigation Lands acquired to meet the NBHCP’s Mitigation Requirement shall function in perpetuity to provide Habitat Values for the Covered Species.
At the same time, CDFG may propose any amendments to the NBHCP CDFG deems reasonably necessary to preserve Habitat Values for the benefit of such species.
The term "Habitat Values" means the capability of a land or water area or associated areas, where indigenous plant(s) or animal(s), individually or collectively, may occur and upon which the Covered Species are dependent, in whole or in part, to provide for some or all of their maintenance, growth and reproduction.
