GST Election definition

GST Election has the meaning specified in Section 5.13.
GST Election shall have the meaning ascribed to such term in Section 1.7 of this Agreement.

Examples of GST Election in a sentence

  • Canadian Purchaser and APC shall promptly notify the other in the event of having any material communication with the Canada Revenue Agency in respect of any such GST Election or the VAT treatment of the sale of the Sale Assets and shall consult with, and take account of the reasonable comments of, the other prior to making any material response to such communication.

  • Canadian Purchaser shall forthwith provide evidence, in form reasonably acceptable to APC, that the GST Election has been duly and timely submitted.

  • Within 10 Business Days following receipt of any such draft joint election, APC and Canadian Purchaser shall each sign and Canadian Purchaser shall submit, in accordance with applicable law and practice, the joint election (the GST Election) in the form of the draft joint election as amended to include any reasonable comments of APC.

  • The Seller and the Purchaser, as applicable, shall file the GST Election, the Section 22 Election and the Section 20(24) Election within the time prescribed by the ETA and Tax Act, as applicable.

  • GST (Subclause 2.03A): (i) GST Election: Alternate __NA (USA Properties)_ (ii) GST Business #: NA 2.

  • Notwithstanding the foregoing, if the GST Election referred to above is not applicable, Buyer shall or shall cause Canadian Buyer to pay to Selkirk Canada, the applicable GST.

  • If the Purchaser wishes to make such election, the Purchaser shall provide to the Vendor at Closing a duly completed Goods and Services Tax ("GST") Form #GST 44, "Election Concerning the Acquisition of a Business or Part of a Business" (the "GST Election") in the prescribed form and containing the prescribed information and the Vendor and the Purchaser will execute such form.
