Grounds Maintenance definition

Grounds Maintenance shall have the meaning described in Section 4.3 of the Agreement.
Grounds Maintenance as set forth in Section 10(f), Tenant shall keep and maintain the Outside Area in good, safe and sanitary order, condition and repair and in compliance with Legal Requirements in accordance with Section 6(e). All repairs and replacements required of Tenant shall be promptly made with new materials of like kind and quality. If and to the extent Tenant's obligations under this Section require replacement of a Building System, Tenant shall have the right to cause Landlord to perform such replacement, and Tenant shall pay to Landlord as Additional Rent the amortized cost of such improvement over the useful life of such repair or improvement pursuant to a commercially reasonable amortization schedule. If the work affects the structural elements of the Premises or if the estimated cost of any item of repair or replacement is in excess of Five Thousand Dollars ($5,000), Tenant shall first obtain Landlord's written approval of the scope of the work, the plans for the work, the materials to be used, and the contractor hired to perform the work, which approval shall not be unreasonably withheld or delayed.
Grounds Maintenance. The Berlin Heritage Foundation, Inc. has a scheduled grounds maintenance program. It will be the responsibility of the Licensee to inspect and ensure that the grounds are satisfactory for the RESTROOM FACILITIES: The Licensor will not provide restroom facilities for any event or occasion. Port-a Potty facilities must be rented by the Licensee and placed in an appropriate location.

Grounds Maintenance will include keeping areas clean, mowed, orderly and free from debris and waste materials. Lessor retains full rights to utilize the areas concerned, including the right to grant easements for utilities, installation of signs, etc., and Lessee shall not be deemed as having any tenancy in these areas. Lessee shall not be responsible for any additional maintenance costs arising out of the foregoing acts of Lessor. Lessor shall have the right to withdraw all or part of Lessee's responsibility under this Section 5.3, if Lessor so desires and so informs Lessee in writing. In any instance in which construction of roads or railroads has been commenced but not completed within or adjacent to the Leased Premises, Lessee shall be responsible for ground maintenance of the areas between the Leased Premises and existing road and railroad improvements as have been or are in the process of being constructed in the adjoining rights-of-way therefor. If no road or railroad improvements shall exist, Lessee shall maintain the areas from the Leased Premises to the centerline of future roads and railroads as are shown on the Tulsa Port of Catoosa Master Development Plan, and as may be reflected in Exhibit "A". Notwithstanding the requirements of this Section, Lessee shall not be required to undertake ground maintenance with respect to any areas between the Leased Premises and any road or railroad improvements or rights-of-way therefor in excess of a 50-foot distance from the Leased Premises.
