The CITY OF DECATUR shall comply with the Privacy Act of 1974 (5 U.S.C. Section 552a) and the rules and regulations issued pursuant to the Act when the performance of this Agreement involves activities associated with maintaining a system of records on individuals to be operated by the CITY OF DECATUR, its contractors or employees to accomplish a Government function.
For purposes of the Privacy Act, when the Agreement involves the operation of a system of records on individuals to accomplish a Federal Government function, the City, third-party Contractors and any of their employees is considered to be an employee of the Government with respect to the Government function and the requirements of the Act, are applicable except that the criminal penalties shall not apply with regard to contracts effective prior to September 27, 1975.
In Accordance with A-76, (dated May 29, 2003 revised), Section 4 (b) and Attachment A Section (b)(1), the parties agree that the nature of BUE work is an inherently Government function.
This should contribute to an improvement in the perception of Government function and improved investor confidence.
