Generation attributes means the non-price characteristics of the electrical energy output of a generation unit including, but not limited to, the unit’s location, fuel type, actual emissions, vintage and policy eligibility. The Commission may modify this list as appropriate.

• Any Generation Attributes and revenues (including any revenues paid by the NYISO) associated therewith (other than energy, capacity and ancillary services and revenues and losses resulting from hedging activities), whether financially settled or otherwise, shall accrue to RGE’s benefit, either as a credit to the Monthly Fixed Amount or as a transfer of title of such Generation Attributes to RGE for the duration of the Term, as ▇▇▇▇▇ may elect.

Examples of Generation Attributes include, but are not limited to: RECs, the avoidance of the emission of any gas, chemical or other substance into the air, soil or water, or the reduction, displacement or offset of emissions resulting from fuel combustion at another location pursuant to any federal, state or local legislation or regulation addressing “greenhouse gases” or similar emissions as well as environmental or renewable energy credit trading program or any similar program now existing or hereafter developed under federal, state, local or foreign legislation or regulation or by any independent certification board or group generally recognized in the electric power industry. Generation Attributes include all rights to report ownership of any of the foregoing to any entity, organization, governmental body, or otherwise at Purchaser’s sole discretion, in each case that correspond to the Energy sold and delivered to Purchaser hereunder.
