Licensee agrees and acknowledges that it shall not use the FXTrade System or the Licensed Materials in order to engage in any Unauthorized Activity.
Payment Orders or any communication amending or cancelling a Payment Order must be sent: (a) by electronic communication through the FXTrade System, or (b) via e-mail which OANDA reasonably believes originated from the e-mail address registered to your FXTrade Account.
Except to the extent required by applicable law, OANDA (a) disclaims any express or implied warranties and conditions, including without limitation any warranties as to non-infringement, merchantability or fitness for a particular purpose; and (b) does not warrant that the FXTrade System, the Licensed Material, or any content therein will be uninterrupted or error free, or that defects will be corrected.
Licensee acknowledges that the FXTrade System and the Licensed Materials permit Licensee to trade derivatives on a highly leveraged basis.
Licensee acknowledges that OANDA does not control signal power, its reception or routing via the internet, configuration of Licensee’s equipment or reliability of its connection, and OANDA shall not be responsible for any communication failures, disruptions, errors, distortions or delays Licensee may experience when trading via the internet using the FXTrade System or the Licensed Materials.
Licensee acknowledges and agrees that Licensee is solely and exclusively responsible for the control, operation and security of Transactions and communications made through its access to or use of the FXTrade System and the Licensed Materials.
The use of the FXTrade System and the Licensed Materials is at Licensee’s own risk, and Licensee assumes full responsibility and risk of loss it may suffer as a result of using, or accessing the FXTrade System and Licensed Materials, or downloading any content thereon.
Licensee acknowledges that it is aware of the risks of engaging in derivatives trading using the FXTrade System and the Licensed Materials and that it shall use and access the FXTrade System and the Licensed Materials at its own risk.
The Licensed Materials and the FXTrade System are provided “as is” except to the extent required by applicable law.
