FWS Permit definition
FWS Permit means and refer to that certain the final Habitat Conservation Plan (“HCP”) and Incidental Take Permit issued by the U.S. Fish and Wildlife Service (the “FWS”) in connection with the development of the Properties, a copy of which is attached hereto as Exhibit “C” and is incorporated by reference.

The REA shall not be modified in a manner that affects implementation of the FWS Permit without prior written approval by FWS.
