Future Claimant definition

Future Claimant means a Person who (a) held a Sexual Abuse Claim as of the Bar Date; and (b) meets one of the following criteria: (i) was under the age of majority under applicable state law as of March 1, 2019; (ii) as of March 1, 2019, the statute of limitations for such Person was tolled under applicable state law or had not begun to run under applicable state law, including because of a Sexual Abuse Claim based on repressed memory or similar theory; (iii) as of March 1, 2019, the Debtor was estopped under applicable state law from asserting the statute of limitations; or (iv) such Person’s Sexual Abuse Claim was barred by the applicable statute of limitations as of March 1, 2019, but is or becomes no longer barred by the applicable statute of limitations for any reason, including the enactment of legislation that revives such Claims; provided, however, that the following persons are not Future Claimants: any Person who has, at any time before the Bar Date, asserted a Sexual Abuse Claim, asserted a cause of action based on a Sexual Abuse Claim, provided notice of a Sexual Abuse Claim, or made a demand based on a Sexual Abuse Claim, or whose parent or guardian or other legal representative had done so on behalf of such Person, at any time before the Bar Date.‌
Future Claimant means a Person or Entity who asserts a Future Claim.
Future Claimant means any Entity who is or becomes the holder of a Demand.

Examples of Future Claimant in a sentence

  • On or before the date which is 15 years immediately following the Effective Date (the “Future Claims Bar Date”), each Future Claimant and Supplemental Present Tort Claimant (if any), must personally file a complaint with the District Court asserting a Claim against APCRF or such Claim will be forever barred.

  • Commencing with the application of the Additional Royalty for each Authorized Future Claimant (the “Implementation Date”), SME shall report royalties on Foreign Streams attributed to Subject Recordings as a percentage of At-Source Revenue (defined below) that is equal to the sum of the Effective At-Source Rate and the Additional Royalty (the “New Effective Rate”).

  • For the avoidance of doubt, the New Effective Rate is inclusive of the Additional Royalty provided for in the first sentence of this Paragraph 20(b) and shall be the total royalty to be credited to each Authorized Future Claimant with respect to Foreign Streams attributed to Subject Recordings on and after the Implementation Date.

  • The Treasurer may pay the expenses associated with providing such Notice from the Unclaimed Property Trust Fund or from other funds appropriated to the Treasurer, provided that: (a) such payments will not reduce the amount of just compensation due or paid to any Class Member or Future Claimant, and (b) the Treasurer shall at all times maintain sufficient funds in the Unclaimed Property Trust Fund to make prompt payment of claims and just compensation on claims of Class Members and Future Claimants.
