Fraudulent Maneuvers definition

Fraudulent Maneuvers means a misrepresentation of facts with the aim of influencing the procurement process or the performance of the Contract to the detriment of the Contracting Authority, and includes collusion between bidders or between bidders and the Contracting Authority (before or after submission of bids) with a view to fixing bid prices at artificial and non-competitive levels and depriving the Contracting Authority of the benefits of free and open competition.
Fraudulent Maneuvers means any act, which distorts or distorts the facts in order to influence the attribution or execution of a contract in a manner detrimental to SCI Niger. "Fraudulent manoeuvres" include any agreement or manoeuvre collusive by bidders (before or after the submission of the offer) aimed at artificially maintaining the prices of offers at levels not corresponding to those which Free and open competition, and to deprive SCI Niger of the advantages of the latter.

A Dishonest or Fraudulent Act does not mean or include a reckless act, a negligent act, or a grossly negligent act.

  • Fraudulent Conveyance means a fraudulent conveyance under Section 548 of Chapter 11 of Title II of the Bankruptcy Code or a fraudulent conveyance or fraudulent transfer under the applicable provisions of any fraudulent conveyance or fraudulent transfer law or similar law of any state, nation or other governmental unit, as in effect from time to time.

  • Fraudulent Transfer Laws has the meaning set forth in Section 2.2.
