This review will encompass the Nutrition Labeling and Education Act (NLEA) and the Fair Packaging and Labeling Act (FPLA) as well as other State and Federal Laws.
Without limiting the foregoing, the Seller Products (i) are, and have been in the past three (3) years, in compliance with all applicable federal and state labeling requirements, including the FDCA, the FPLA and all regulations under the FDA Laws, and (ii) if so required, have been manufactured in all material respects in accordance with the Laws of such jurisdictions where such Seller Products are manufactured, and are not, and have not been, adulterated, mislabeled or misbranded.
