Form, Fit or Function definition

Form, Fit or Function shall have the following meaning. "Form" means shape; "Fit" means physical size or mounting arrangement (e.g., electrical or mechanical connections); and "Function" means features and capabilities.

Examples of Form, Fit or Function in a sentence

  • With respect to changes, modifications, and substitutions that do impact the Form, Fit, or Function of the ordered Product, Seller shall notify Customer in writing thirty (30) days prior to the date the changes become effective.

  • Seller agrees that such modifications or substitutions will not impact upon Form, Fit, or Function under normal and proper use of the ordered Product as provided in Seller's Specifications.

  • Additionally, CES requires notification of any change in manufacturing facility locations whether or not you (the supplier) feel it will affect Form, Fit, or Function.

  • Corvis will provide Qwest with (a) updates to the Documentation, as such updates are made generally available, and (b) new and/or revised data incorporating any changes to the Products which affect Form, Fit, or Function, in each case at no additional charge to Qwest.

  • Any Form, Fit, or Function changes to the items listed that affect existing inventory or assembly processes shall be subject to the conditions stated in Section 6.

  • Proprietary 18 thereto, or substitute Products of later design to fill an order, provided the changes, modifications, or substitutions under normal and proper use do not impact upon the Form, Fit, or Function of an ordered Product as identified in Seller's specifications.

  • Supplier will, at its own discretion, make such additions, modifications or adjustments to the Release of the Software commonly known as the Current Release except if such adversely affects the Form, Fit or Function, in which case Qwest may refuse to accept such without amending its rights or Supplier's obligations hereunder.

  • In repairing or replacing any Product, part of Product, or Software medium under this warranty, Seller may use either new, remanufactured, reconditioned, refurbished or functionally equivalent Products or parts; provided, however, that such repair or replacement will not impact upon the Form, Fit or Function of the Product or Software under normal and proper use, as provided in Seller's Specifications.

  • With respect to changes, modifications, and substitutions that do impact the Form, Fit, or Function of the ordered Product, Seller shall notify Customer in writing at least four (4) months prior to the date the changes become effective, except in those cases where the change is the result of legal mandate or changes in recognized industry standards for which the notice period to Customer shall be at least thirty (30) days.

  • Supplier may make changes to MATERIAL, modify drawings, or make changes to manufacturing specifications, provided the changes, modifications, or substitutions DO NOT have an impact on the performance, reliability, Form, Fit, or Function of the MATERIAL without prior notification to Company.

  • School function means any school-sponsored extra-curricular event or activity.

  • Form, fit, and function data means technical data that describes the required overall physical, functional, and performance characteristics (along with the qualification requirements, if applicable) of an item, component, or process to the extent necessary to permit identification of physically and functionally interchangeable items.

  • Governmental function means an activity that is expressly or impliedly mandated or authorized by constitution, statute, local charter or ordinance, or other law. Governmental function includes an activity performed on public or private property by a sworn law enforcement officer within the scope of the law enforcement officer's authority, as directed or assigned by his or her public employer for the purpose of public safety.

  • Register Function means the functions with regard to:

  • critical functions means activities, services or operations the discontinuance of which is likely in one or more Member States, to lead to the disruption of services that are essential to the real economy or to disrupt financial stability due to the size, market share, external and internal interconnectedness, complexity or cross-border activities of an institution or group, with particular regard to the substitutability of those activities, services or operations;
