Forex Contingency Order definition
Forex Contingency Order means (a) a Final Order, including, without limitation, a Final Order approving a settlement, that determines that Forex and Metals Customers do not have a superior direct claim to, a superior direct interest in, or any other superior right to any portion of the Customer Pooled Funds Allocation, or any determination by Final Order having such effect or (b) a Final Order approving a settlement between the Estate and Forex and Metals Customers that is acceptable to the Trustee and the Customer Representative Plaintiffs and that is otherwise consistent with the provisions of the Settlement Agreement.
