Forepart definition

Forepart means the forepart of the Series Trust Agreement into which these Standard Terms are incorporated by reference, consisting of the provisions actually set forth in the pages of the Series Trust Agreement preceding and including its signature page, together with all exhibits thereto except these Standard Terms.
Forepart means the forepart of this Series Trust Agreement, consisting of the provisions contained on this page and each consecutive page thereafter to and including the signature page (page __), together with all Exhibits hereto (which are hereby incorporated by reference and shall be part of this Series Trust Agreement as fully as if set forth herein at length), other than the Standard Terms. All capitalized terms not defined herein shall have the meanings assigned to such terms in the Standard Terms.
Forepart means the front part of a vessel.

Examples of Forepart in a sentence

  • The Trust shall not take any action that would cause it to fail to be classified as a grantor trust or, if specified in the Forepart, as a partnership, or otherwise, as may be specified in the Forepart for federal income tax purposes.

  • All Certificates of all Classes at any time Outstanding shall be identical except for differences among the Certificates of the different Classes specified in the Forepart.

  • Unless otherwise specified in the Forepart, the initial Certificate Registrar shall be the Trustee.

  • As a condition of exercising any such rights, if the Trust is intended to qualify as a grantor trust, the Trustee may require an opinion of counsel to the effect that exercising such rights would not cause the Trust to fail to qualify as a grantor trust (or fail to have such other qualification as may be specified in the Forepart).

  • Pending application pursuant to Sections 6.2 or 8.2 hereof, moneys held in the Collection Account shall not be reinvested except as provided in the Forepart.

  • These Standard Terms shall be of no force and effect unless and until incorporated by reference into the Forepart of a particular Series Trust Agreement (each as defined herein).

  • Except as expressly provided herein, any action that may be taken or consent that may be given or withheld by the Certificateholders under the Series Trust Agreement may be taken, given or withheld by Certificateholders evidencing a majority of the Certificate Principal Balance of all Classes or of the Voting Rights if the Voting Rights are allocated by Class in the Forepart.

  • The following terms and provisions shall govern the Certificates and the Trust subject to contrary terms and provisions expressly set forth in the Forepart of the Series Trust Agreement, which contrary terms and provisions shall control; provided, that no such term or provisions of the Forepart may limit, qualify or conflict with Section 10.11 hereof.

  • If the Grantee makes a deferral election under Section 5 of the Forepart of the Program, the Grantee shall also be awarded DERs with respect to each deferred Share.

  • Failure by the Depositor to pay, reimburse or indemnify the Trustee shall not entitle the Trustee to any payment, reimbursement or indemnification from the Trust unless otherwise specified in the Forepart, nor shall such failure release the Trustee from the duties it is required to perform under the Series Trust Agreement.

  • Preliminary Statement shall have the meaning set forth in Section 2.3(c).

  • Breach Notice means a written notice of breach given by one Party to the other, notifying the Party receiving the notice of its breach of this Contract;

  • Glossary means this current section of the Agreement.

  • Master Definitions Schedule means the amended and restated schedule of definitions relating to the Programme originally dated the Programme Effective Date and as most recently amended and restated on 18 December 2020 (as further amended, supplemented and/or replaced from time to time).
