The Forecast Data may only be used by the Licensee, and the Licensee may not rent, lease, lend, sub-license or transfer the Forecast Data or any of its rights under this agreement to anyone else, except under the following terms and conditions.
In no event shall the Licensor be liable for any damages whatsoever arising out of or in connection with the use of, or inability to use the Forecast Data, even if the Licensor has been advised of the possibility of such damages.
The Licensee also has the right to create derivative work with the Forecast Data, but has the obligation, whether the Forecast Data is used “AS IS” or in a derivative work, to acknowledge the source of the Forecast Data with the following layout: based on Environment Canada data.
No fee will be charged explicitly for the Forecast Data distributed to any third party, but the Licensee can charge for value-added services.
