Forced Unavailability definition

Forced Unavailability means an interruption of or a reduction in the Availability of any Facility that is the result of: (a) a maximum capacity utilization of such Facility, as notified by the Concessionaire to the KMC in accordance with Article 8.9; (b) a suspension of the performance of the O&M services for such Facility pursuant to Article 15.1(a)(i) or Article 15.2(a)(i), to the extent any such event is not attributable to the Concessionaire; or (c) unavailability or breakdown of the Supporting Infrastructure for such Facility .
Forced Unavailability means an interruption of or a reduction in the Availability of any STP Facility that is the result of: (a) a maximum capacity utilization of such STP Facility, as notified by the Concessionaire to BUIDCO in accordance with Clause 8.9; (b) a suspension of the performance of the O&M services for such STP Facility pursuant to Clause 15.1(a)(i) or Clause 15.2(a)(i), to the extent any such event is not attributable to the Concessionaire; or (c) unavailability or breakdown of the Supporting Infrastructure for such STP Facility.

Examples of Forced Unavailability in a sentence

  • Forced Unavailability of Lines making necessary to activated automatic disconnections of generation and/or loading, not previously activated, will be sanctioned in a separated and additional way.

  • Notwithstanding anything to the contrary contained in this Agreement, during the period of a Forced Unavailability or a Force Majeure, the Facility affected by such Forced Unavailability or a Force Majeure will be deemed to be Available.

  • In such circumstances, if the Concessionaire is unable to accept and treat the excess Sewage (i.e., over and above the Design Capacity) at the relevant Kolkata STP, then such failure shall be treated as a Forced Unavailability for which the Concessionaire shall not be liable, subject to the Concessionaire having notified the KMC in accordance with Article 8.9(b) above.

  • The sanction to apply on the eąuipment considered in Programmed Unavailability will be fixed by the Commission at the percentage suitable to those assumed for Forced Unavailability.

  • If the Carrier operating in normal conditions, by reasons attributed thereto does not comply with the power levels stipulated in NTCSTS will be sanctioned according to and also as Forced Unavailability of the equipment necessary to be installed to meet the required power levels.

  • The sanction to apply on the equipment considered in Programmed Unavailability will be fixed by the Commission at the percentage suitable to those assumed for Forced Unavailability.

  • Notwithstanding anything to the contrary contained in this Agreement, during the period of a Forced Unavailability or a Force Majeure, the STP affected by such Forced Unavailability or a Force Majeure will be deemed to be Available.

  • If the Carrier operating in normal conditions, by reasons attributed thereto does not comply with the power levels stipulated in NTCSTS will be sanctioned according to and also as Forced Unavailability of the eąuipment necessary to be installed to meet the reąuired power levels.

Related to Forced Unavailability

  • Scheduled Unavailability Date has the meaning specified in Section 3.03(b).

  • Unavailability (or “Unavailable”) the Flexibility Services, in accordance with the Service Requirements, are not Available to be delivered to the Company; “Utilisation Instruction” an instruction by the Company to the Provider to deliver Flexibility Services;

  • Forced Outage means any unplanned reduction or suspension of the electrical output from the Facility resulting in the unavailability of the Facility, in whole or in part, in response to a mechanical, electrical, or hydraulic control system trip or operator-initiated trip in response to an alarm or equipment malfunction and any other unavailability of the Facility for operation, in whole or in part, for maintenance or repair that is not a scheduled maintenance outage and not the result of Force Majeure.

  • Benchmark Unavailability Period means, the period (if any) (a) beginning at the time that a Benchmark Replacement Date has occurred if, at such time, no Benchmark Replacement has replaced the then-current Benchmark for all purposes hereunder and under any Loan Document in accordance with Section 3.03 and (b) ending at the time that a Benchmark Replacement has replaced the then-current Benchmark for all purposes hereunder and under any Loan Document in accordance with Section 3.03.

  • Suppressed Availability means, at any time, an amount, if positive, by which the Borrowing Base at such time exceeds the Aggregate Commitments at such time; provided that Suppressed Availability at any time shall not exceed 2.5% of the Aggregate Commitments at such time.
