Force Major definition

Force Major means any event beyond the reasonable control of either party including, amongst other things, unpredictable adverse weather conditions, national industrial strikes (excluding strikes or labour disputes originated by or involving only the relevant party’s workforce or any part of it or the workforce of its agents or sub-contractors), war, acts of God, acts of terrorism, floods, earthquakes or civil disturbance.
Force Major means circumstances in so far as a diligent carrier has been unable to avoid and in so far as such a carrier has been unable to prevent the consequences thereof.
Force Major means any cause arising from or attributable to acts, events or omissions beyond the reasonable control of the party claiming force majeure, including, but not limited to, any act of a governmental department, Act of God, flood, fire, explosion or earthquake, strike, lock-out or industrial dispute or failure of computer equipment, power supplies or telecommunications links;

  • The Custodian will not be responsible for any failure to perform any of its obligations (nor will it be responsible for any unavailability of funds credited to the Cash Account) if such performance is prevented, hindered or delayed by a Force Major Event, in such case its obligations will be suspended for so long as the Force Major Event continues.

  • ASPL shall not be liable for any loss/damage/shortage/pilferage or any kind of loss while offering the services under this Agreement including Force Major Circumstances or circumstances beyond its control.

  • The Parties shall be indemnified for partial or complete non-fulfillment of the obligations under the present Contract if this non-fulfillment comes as a result of exceptional circumstances arisen after the signing of the present Contract and these circumstances and reasons led to them (Force Major) being beyond the parties control affected on the performance of the given Contract.

  • In the event of any Force Major, this Agreement shall be suspended by mutual agreement of both parties, and after Force Major, the parties are again obliged to cooperate jointly.

Force Major for this Agreement means that the parties are insurmountable and subject to their control, which are not related to the mistake or negligence of the grant issuer and / or grantor who has a preliminarily unforeseen nature. Such circumstances may be caused by war, natural disasters, epidemics, quarantine, budgetary problems, etc.
Force Major means: war, acts of hostility within the project areas committed by regular or non-regular armies, enemy invasion, acts or battles by an enemy state, provided however that in the manager's opinion, the concessioner had no control over, nor could they foresee or prevent the same, and provided also that weather conditions, including days of rain, snow and wind and/or reserve military service and/or lack of materials and/or tools and/or equipment, and/or strikes and/or shutdowns and so forth, and/or the exposure of antique relics and/or ▇▇▇▇▇▇, and/or current economy conditions and/or lack of - and/or difficulty to find Israeli and/or foreign construction workers and/or a general or partial curfew preventing the exit of workers from Judea, Samaria and Gazza and including escalation of any of the foregoing, and/or demands and/or claims and/or injunctions issued by other right holders in the project areas and surroundings - will not constitute force major and will not afford the concessioner any extension of the building period.

  • Force Majeure Delays means any actual delay in the construction of the Tenant Improvements, which is beyond the reasonable control of Landlord or Tenant, as the case may be, as described in Paragraph 33 of the Lease.
