Where defect is discovered during the Usufruct Period, the FMW&H undertakes to remedy or procure that the defect is remedied, both at its own cost and expenses within twenty-one (21) days of receiving the notification of the defect from the SPV.
The FMW&H shall through the DMO provide the Trustees with evidence of the payment to the Contractors within five (5) Business Days of the payment.

The remuneration, cost and expenses of the Independent Engineer shall be paid by the Contracting Authority and subject to the limits set forth by the FMWH, one-half of such remuneration, cost and expenses shall be reimbursed by the Concessionaire to the Contracting Authority within 15 (fifteen) days of receiving a statement of expenditure from the Contracting Authority.
