Such designation of FMOG as Acting Operator shall not constitute a resignation or termination by Freeport of its duties as Operator hereunder.
Freeport, IMC and Felmont are concurrently entering into a separate agreement effective as of the date of this Agreement and entitled "Agreement Designating Acting Operator" whereby Freeport-McMoRan Oil & Gas Company ("FMOG"), a Delaware corporation and an affiliate of Freeport is designated as the "Acting Operator" for the Property, pursuant to the terms and conditions of said agreement.
For the avoidance of doubt, all references herein to the Borrowers shall give effect to the accession of FMOG as a party hereto in the capacity of a Borrower pursuant to Section 4.02(c) of the Existing Revolving Credit Agreement and the cessation of FMOG as a party hereto in the capacity of a Borrower pursuant to Section 10.02(g).
For the avoidance of doubt, all references herein (whether in singular or plural, as the context requires) to the Borrower shall give effect to the accession of FMOG as a party hereto in the capacity of a borrower pursuant to Section 4.02(c) or 4.04(c) of the Existing Credit Agreement and the cessation of FMOG as a party hereto in the capacity of a borrower pursuant to Section 10.02(g).
