FLIX or "Sundance Channel", in each case for so long as they continue to be fundamentally in nature as they currently are. "Pay-per-view Basis" shall mean the mode of television exhibition whereby individuals in substance and effect are (a) provided with the limited right to view single or multiple exhibitions of a single program on a scheduled basis only and (b) charged a distinct, incremental fee for such right. "VOD Basis" shall mean a mode of television exhibition whereby individuals in substance and effect are (a) provided with the right, at their sole discretion, to select the commencement time for an otherwise unscheduled viewing of a single program and (b) charged a distinct, incremental fee for such right.
