Flavor definition

Flavor means a blend of two or more ingredients, including one or more Ingredients and which is used primarily to impart, modify, boost or enhance a desirable taste, flavor, or sensation, or to conceal, modify or minimize an undesirable taste, flavor, or sensation, in materials designed for consumption (including food, beverages, drugs and tobacco and any animal feed).
Flavor and “Flavored” means any Cigarette that contains a Constituent that imparts a Characterizing Flavor, with “Characterizing Flavor” and “Constituentshaving the same meaning as subparts (a)(1) and (a)(2) of Health and Safety Code section 104559.5.

Accordingly, this 10 injunction hereby expressly allows Defendant and its packaging suppliers, bottlers, distributors, 11 wholesalers and retailers of Xxxxxxx’x Xxxxxx Ale Products to sell-through all remaining stock of 12 the existing label and introduce the new label as they sell through existing stock. The sell-through 13 shall not require the withdrawal or destruction of any existing labels or recall of Product. Instead, 14 the new label shall begin to be phased into the market on or about the later of 120 days after the 15 Effective Date or June 1, 2019, and the transition to new labels shall be completed no later than 16 the later of 120 days after the Effective Date or January 1, 2020 (or any further extension of the 00 Xxxxxx Xxxxxx Food and Drug Administration’s deadline for new nutrition fact panel changes); 18 provided, however, that because Defendant cannot control all sources of old stock in the market, 19 neither Defendant nor any bottler, distributor, wholesaler or retailer would be penalized or be 20 liable for de minimis sales of old stock after that date.
