Fixed night shift definition
Fixed night shift means a Night shift on which an employee is not allowed to rotate so as to give the employee at least one (1) week in each three (3) consecutive weeks on some other shift or shifts.

A three shift system is where rosters are set on a three weekly basis that provide for one week of day shift, one week of afternoon shift and one week of night shift unless otherwise agreed between the employer and the employees concerned. Employees who work all of their ordinary hours within the span of hours prescribed in clause 2.5 and who are not part of a rotating 3 shift system are not shift workers and are not subject to any part of this clause.

A shift worker who works on an afternoon shift or night shift which does not continue for at least five successive afternoons or night shifts shall be paid for each such shift 50% for the first three hours thereof and 100% for the remaining hours thereof in addition to this ordinary rate without 7 days notice of change. A casual employee employed on shift work shall receive the appropriate percentage loading as prescribed by this clause and in addition thereto 20% (i.e. casual loading as prescribed by this clause of the appropriate classification rate i.e. not inclusive of the shift work percentage loading as prescribed by this clause.
