Notwithstanding anything in this Agreement to the contrary, First USA may assign part or all of its obligations and duties as Servicer under this Agreement to an Affiliate of First USA so long as First USA shall have fully guaranteed the performance of such obligations and duties under this Agreement.
The Trustee further acknowledges that, prior to or simultaneously with the execution and delivery of this Agreement, First USA delivered to the Trustee the computer file or microfiche list described in Section 2.01.
