First Customer Shipment means the first commercial shipment of the CI Product by DeltaPoint or its agents or customers to any retail distributor or other customer that is paying a license fee or purchase price therefor, and is not an alpha or beta site evaluation customer of such product. First Customer Shipment. “First Customer Ship” or “FCS” shall mean the date on which units of Products are generally available from Dot Hill for delivery in volume by NetApp to NetApp’s customers.
