These Terms and Conditions of Business Services (formerly referred to as the Business Conditions of Use or Ethernet and MPLS Conditions of Use) (the “T&Cs”) govern the provision by First Communications, LLC (“First Communications” or “Company”) of all Services (defined below).
To the extent the Service and/or Agreement is not subject to FCC or state utility regulation, you agree that the laws of the State of Ohio govern the Agreement and the relationship between First Communications and you, without regard to conflict of laws principles.
As defined in this SLA, a Point of Presence (“POP”) means a First Communications POP location that represents the provider edge of the IP Network.

First Communications does not and cannot control third-party connectivity and has no responsibility related to contracting, service and/or arrangements of Customer with Customer’s cloud service provider or performance thereunder.
To receive service credits, within three days of occurrence of Unavailability, Customer must contact First Communications’ Customer Care at ▇▇▇-▇▇▇-▇▇▇▇ to report such Unavailability and open and submit the relevant trouble ticket information for First Communications to investigate and isolate the cause of Unavailability.
Customer shall not exceed the number of endpoints set forth in its applicable Service Order and/or subscription, and in the event Customer violates this restriction as reasonably determined by First Communications in its discretion, First Communications will retroactively charge Customer for all applicable fees for such additional endpoints and may continue invoicing such additional fees on an ongoing basis as part of Customer’s MRC or on a retroactive basis.
