First Class Facility definition

First Class Facility means a facility that has been renovated from time to time to modern standards, to the extent necessary to attract a high percentage occupancy and generate high gross proceeds from the operation of the Airport;

  • Landlord and Tenant agree that Tenant shall be obligated to complete the Coliseum Renovation, at its sole cost and expense, in a manner that satisfies the First Class Facility Standard and the Scope of Work, in a total amount not less than the Estimated Project Cost and otherwise in accordance with and subject to this Lease.

More Definitions of First Class Facility

First Class Facility means a state-of-the-art Major League Baseball park that is capable of hosting events other than baseball, including concerts, family entertainment and meeting/special events, wherein the level and quality of: (a) the baseball park amenities (such as private suites, restaurants and concessions located in or around the Ballpark Property) are consistent with the level and quality of amenities in other Major League Baseball parks built or under construction within five years prior to the Effective Date to host Major League Baseball events, and (b) interior and exterior Ballpark Property finishes are comparable to the level and quality of interior and exterior finishes in Major League Baseball parks built within five years prior to the Effective Date to host Major League Baseball and other events.
First Class Facility means a state-of-the-art Major League Baseball park wherein the level and quality of: (a) the baseball facilities, including the playing field and amenities, are consistent with the level and quality of other Major League Baseball parks built within five years prior to the Closing Date (one year prior to the Closing Date in the case of public safety and security components) for the purpose of hosting Major League Baseball Games and (b) interior and exterior Ballpark finishes are comparable to the level and quality of interior and exterior finishes in Major League Baseball parks built within five years prior to Closing Date for the purpose of hosting Major League Baseball Games.
First Class Facility. Standard shall mean a standard for the design and construction of the Coliseum Plaza Improvements which shall, following the procedure hereinafter set forth in Article 5 of this Lease, provide plans and specifications for the Coliseum Plaza Improvements that will result in the construction of a first class facility that is comparable to, but not identical to, the entertainment related components of the Ridge Hill Shopping Center in Yonkers, New York (or, in the case of a music venue, a newly constructed Fillmore or House of Blues theater), and will comply with Legal Requirements; provided, however, that it is understood and agreed that the Coliseum Plaza Improvements will not be exactly the same as the entertainment related components of the Ridge Hill Shopping Center in Yonkers, New York (or, in the case of a music venue, a newly constructed Fillmore or House of Blues theater), and will have, for example, different types and numbers of amenities, restaurants, vendors, size, levels, design, public spaces, and occupants (or, in the case of a music venue, different size, architectural details, seating capacities and/or configurations, food service options, and the like).
First Class Facility means a mixed-use downtown project meeting the following criteria: (1) developed with the Minimum Project; (2) no Retail store shall exceed 100,000 square feet of floor area (other than the stores on the Macy’s Parcel and the Target Parcel); (3) the total floor area square footage of all Retail stores exceeding 28,000 square feet of floor area each (other than the stores on the Macy’s Parcel and the Target Parcel and any movie theater or grocery store) does not exceed ▇▇▇,▇▇▇ ▇▇▇▇▇▇ ▇▇▇▇ ▇▇ ▇▇▇▇▇ ▇▇▇▇; (4) no Retail store advertises that all or substantially all of the goods it sells do not exceed a particular price; (5) no more than thirty-five percent (35%) of the Retail space is rented to manufacturer’s outlet stores; and (6) the facilities in the Project are maintained in a first-class manner comparable to other similar projects in the San ▇▇▇▇ metropolitan area.
