The Parties agree that the Council may, in its absolute discretion, make a notation under section 149(5) of the Act regarding this Agreement on any certificate issued under section 149(2) of the Act relating to the Land, other than a Final Lot.
For avoidance of doubt, this clause 3 does not cease to apply merely because this Agreement is not registered on the title of a Final Lot or because the owner of a Final Lot is not a party to this Agreement.

The intersection upgrade(s) on Appin Road must be completed immediately prior to the issue of the subdivision certificate for the creation of the first Final Lot in stage 1.
Nothing in this Deed prevents the registration of a Plan of Subdivision in respect of the Land nor the creation of a Final Lot from the Land.
For the dedication of the land (to expand the ▇▇▇▇▇▇ ▇▇▇▇▇ Oval public reserve), the contribution is tied to the creation of the first Final Lot in stage 3.
