If the Plan is adopted as a standardized Plan, upon initial adoption of this Plan or upon a Plan amendment which is effective on or after the Final Compliance Date, no more than 5 years of credit shall be granted for service completed before the effective date of such adoption or amendment, and any such past service credit shall be granted on a uniform basis to all Participants in the Plan on such effective date.
For Plan Years beginning on and after the Final Compliance Date, such plans may be aggregated only if they have the same plan years and they are not mandatorily disaggregated under regulations under Code section 401(m).
If this section 12.3(b) applies and the Employer has not elected to provide the minimum benefit accrual under the defined benefit Paired Plan, the minimum allocation required under this section 12.3(b) for Plan Years beginning on and after the Final Compliance Date shall, subject to the ordering rules in section 12.3(c), be made under this Plan without regard to whether the Participant also benefits under the defined benefit Paired Plan.
