Fidelity Technology means:

For purposes of this Agreement, “Envestnet Technology” shall mean (i) the Software and (ii) any and all third-party materials incorporated into or made available by Envestnet in connection with the Software, except any materials or items that represent Fidelity Technology.
Fidelity shall ensure that the Fidelity Technology utilized in connection with this Agreement complies with all applicable legal and regulatory requirements.
