Fiber System is defined for purposes of this Supplement to mean an existing twelve (12) strand system of Tempe-owned fiber running from Tempe Main located at ▇▇ ▇. ▇▇▇ ▇▇▇▇▇▇ (City Hall) to the ASU Center Point building located at ▇▇▇ ▇. ▇▇▇▇ ▇▇▇. “Facility” means two (2) fiber optic strands within the Fiber System.   • Except as otherwise may be agreed to by the parties, User is prohibited from performing any maintenance or repair on the Fiber System or User System.

  • User shall be responsible for any and all costs associated with lateral connectivity to the Fiber System and shall pay for the costs of all splicing, distribution segment, service connections, and any ring or concentrator operations.

  • The Parties intend that nothing contained in this Agreement should act as a limitation, restriction, or prohibition against the City with respect to any agreement which the City has heretofore entered into, or may in the future enter into with others regarding the Burlington Fiber System, including the identified portion of the Burlington Fiber System covered by this Agreement.

  • Provide and/or control maintenance and repair functions on the User System and all facilities in the Fiber System through which the User System passes, including, but not limited to, conduit, innerduct, poles and equipment, shall be performed under the direction of the Owner.

  • Customer System means the Customer's computing environment (consisting of hardware, software and/or telecommunications networks or equipment) used by the Customer or the Supplier in connection with this Contract which is owned by or licensed to the Customer by a third party and which interfaces with the Supplier System or which is necessary for the Customer to receive the Services;
