FedEx Lease definition

FedEx Lease means that certain Build-To-Suit Lease Agreement originally by and between B▇▇▇▇ Properties Limited Partnership, predecessor-in-interest to Fieldcrest Borrower, as landlord, and FedEx, as tenant, dated as of January 12, 1995, demising to FedEx all the rentable space at the Fieldcrest Property, as amended by that certain First Amendment to Lease Agreement dated as of March 31, 2011, as further amended by that certain Second Amendment to Lease Agreement dated as of March 31, 2016, and as may be further amended or restated.
FedEx Lease means, with respect to the Blauvelt, NY Individual Property, that certain Lease dated April 4, 2011, between SunCap Orangetown, LLC, as landlord, and FedEx, as tenant (as the same may be amended, restated, renewed and/or extended).
FedEx Lease means that certain Lease, dated as of August 6, 2012, by and between FedEx, as tenant, and SunCap Seattle, LLC, a North Carolina limited liability company, 7 0107842.0726822 4821-7262-8396v10 as predecessor to Borrower, as landlord, as amended by that certain First Amendment to Lease Agreement, dated August 5, 2015, by and between FedEx, as tenant, and ▇▇▇▇▇▇▇▇-▇▇▇▇▇▇▇ LLC, a Washington limited liability company, as predecessor to Borrower, as amended by that certain Second Amendment to Lease Agreement, dated on or about the date hereof, by and between FedEx, as Tenant, and Borrower, as the same may have been or further be modified, amended and/or assigned from time to time.

Examples of FedEx Lease in a sentence

  • FedEx has no claim against Borrower and no offset or defense to enforcement of any of the terms of the FedEx Lease.

  • Lender shall have the right to approve (i) any plans and specifications prepared in connection with the Expansion, (ii) the lease rate to be paid by FedEx upon substantial completion of the Expansion, as well as any amendment to the FedEx Lease confirming said new rent amount or any other matter Borrower has approval rights regarding the Expansion and (iii) all hard and soft costs for the Expansion (the “Expansion Costs”) and the schedule of the work to complete the Expansion.

  • Borrower agrees that Lender may disclose financial information regarding FedEx that is provided to Lender pursuant to the Loan Agreement, including pursuant to this Section 9.1, in connection with the securitization of the Loan to a trust, provided that such disclosure shall be subject to Lender’s customary confidentiality procedures, including, with respect to distribution of the FedEx Lease, via a process that currently includes a click-through confidentiality acknowledgment.

  • Neither Party shall be liable for any loss, injury, delay or damages suffered or incurred by the other Party due to the above causes.

  • To the extent permitted under the FedEx Lease, Lender shall have the right to approve the lease rate to be paid by FedEx upon substantial completion of the Expansion, as well as any amendment to the FedEx Lease confirming said new rent amount or any other matter Borrower has approval rights regarding the Expansion.

  • Borrower acknowledges and agrees that under the Effingham FedEx Lease, FedEx may request that the Effingham Individual Borrower build an expansion of the Improvements on the Effingham Individual Property (the “Expansion Space”).

  • Borrower shall pay all Taxes and Other Charges now or hereafter levied or assessed or imposed against the Property or any part thereof as the same become due and payable; provided, however, Borrower’s obligation to directly pay Taxes shall be suspended if such Taxes are paid directly by FedEx pursuant to the FedEx Lease and for so long as Borrower complies with the terms and provisions of Section 7.2 hereof.

  • All improvements required to be completed by Borrower under the FedEx Lease have been completed and there are no sums due to FedEx from Borrower and no allowances from Borrower to FedEx that have not been paid.

  • New Lease Any lease of REO Property entered into on behalf of REMIC I, including any lease renewed or extended on behalf of REMIC I, if REMIC I has the right to renegotiate the terms of such lease.

  • Operating Lease means, as applied to any Person, any lease (including, without limitation, leases which may be terminated by the lessee at any time) of any Property (whether real, personal or mixed) which is not a Capital Lease other than any such lease in which that Person is the lessor.

  • Lease Agreement means the bargain, with respect to the lease, of the lessor and the lessee in fact as found in their language or by implication from other circumstances including course of dealing or usage of trade or course of performance as provided in this article. Unless the context clearly indicates otherwise, the term includes a sublease agreement.

  • Sub-Lease means the sub-lease entered into following the approval of an Approved Sub-lease;

  • Assignment of Lease means the Assignment of Lease to be executed by the Seller and the Purchaser at the Closing with respect to each parcel of Leased Real Property listed on Section 3.14(b) of the Disclosure Schedule, substantially in the form of Exhibit 1.01(b).
