Customer intends to seek funding from the USAC/SLD, but acknowledges that it may not receive an FCDL prior to this date and that it is possible that USAC/SLD may not approve funding or may delay its decision.
Customer should refer to the E-Rate Rules and Regulations regarding USAC/SLD payments for eligible services delivered after the beginning of the E-Rate year (July 1st) but before receipt of an FCDL.
Accordingly, contingent upon the District’s receipt of a funding commitment decision letter (FCDL) from SLD/USAC and both District’s and Contractor’s compliance with all the SLD/USAC guidelines, vendor shall offer an SLD/USAC discounted invoice payment option.

All sections of this project, other than those sections expressly identified as NON ERATE or ERATE Ineligible, are contingent upon Funding Commitments issued through the FCC E-RATE program, as identified through an FCDL issued by the USAC-SLD of the FCC to the customer.
If the MRC for the Services is lowered under Section 24(f), the “urban rate” is increased, there is a USAC or FCC funding shortfall, Customer has not received an FCL or FCDL committing the full amount of the Customer’s funding request, or there is a material delay in funding (individually or collectively, a “Funding Shortfall Event”) Alaska Communications may, upon 30 days’ written notice to Customer, terminate some or all of the Services.
Early Termination or Site Termination Charges shall not be waived if the Customer fails to receive an FCL or FCDL for any other reason.
