FBL System definition

FBL System means the integrated multi-conduit, multi-ring fiber optic communication system comprised of Innerducts and other conduit tubing, and the Manholes, Handholes, and the Cable located therein and does not include (i) any communications equipment, electronics, optronics or other facilities of FBL or any other Person located within the FBL System or (ii) any Lateral Connections.

  • FBL maintains signposts along the FBL System path and these markers identify the route and are typically placed near splice locations, points where the route changes direction; FBL subscribes to local utility “one call” services for the FBL System.

  • FBL shall inspect the FBL System path at least quarterly by walking or driving the route to ensure that potentially harmful activities do not cross or parallel the FBL System.

  • FBL shall use commercially reasonable efforts to notify Customer in advance of planned intrusive activities on the FBL System that may impair or eliminate signal continuity.

  • Customer and FBL shall promptly notify each other of any matters pertaining to, or the occurrence (or impending occurrence) of, any event which would be reasonably likely to give rise to any damage or impending damage to or loss of the FBL System that are known to such Party.

  • If Customer fails to at least commence corrective measures within twenty-four (24) hours of FBL’s notice, then FBL may take any action it deems appropriate to correct the non-compliance, including directing immediate suspension of work relating to the FBL System.

  • Customer acknowledges that the FBL System includes or will include other participants, including FBL and other owners and Customers of telecommunications systems.

  • If FBL, in its sole discretion, determines that conditions exist within the FBL System that pose an immediate threat of damage to property, injury to or death of any Person, or that a violation exists of any of the Permits, then FBL may direct that all work or use by Customer or others relating to the FBL System, including the Customer Dark Fibers, be immediately suspended until the violation or condition is corrected to FBL’s satisfaction.

  • Neither this Rider nor the Dark Fiber Lease granted hereby conveys any form or type of title in any real or personal property, including the FBL System, any Ring, any Segment, the Customer Dark Fibers or any portion of any of the foregoing.

  • FBL shall have full and complete control and responsibility for determining any routing configurations of the FBL System and the location and configurations of all Manholes and Handholes (including Customer Manholes and Customer Handholes, if any).

  • Customer shall not use its facilities, including without limitation the Customer Dark Fibers and the Customer Equipment, in a way that interferes in any way with or adversely affects the use of the FBL System or any Cable therein or other equipment and facilities of any Person (including FBL) using the FBL System.

Related to FBL System

  • Fuel system means the components which store or transport fuel on board the vehicle and comprise the fuel tank system, all fuel and vapour lines, any non-tank mounted fuel pumps and the activated carbon canister.

  • ▇▇▇▇▇ System means the ▇▇▇▇▇ filing system of the Commission and the rules and regulations pertaining thereto promulgated by the Commission in Regulation S-T under the Securities Act and the Exchange Act, in each case as the same may be amended or succeeded from time to time (and without regard to format).
