Farce Majeure definition

Farce Majeure means, any unforeseeable exceptional situation or event beyond the Contracting Parties control, which prevents either of them from fulfilling any of their obligations under the Contract, which was not attributed to error or negligence on their part, and which proves to be inevitable in spíte of exercising all due diligence. Any default of a service, defect in equipment or material or delays in making them available, unless they stem directly from a relevant case of Farce Majeure, as well as labour disputes, strikes or financial difficulties cannot be invoked as Farce Majeure. - Fundedby 6 the European Union

Examples of Farce Majeure in a sentence

  • At the Purchaser’s option, termination will be effective even if the Farce Majeure ends before the effective date of termination.

  • Each Party will notify the Coordinator of any Farce Majeure without undue delay.

  • In such a case, payment milestones shall be deferred by the duration of the period of the Farce Majeure event.

  • Neither Party will be liable for delay in perfonning or failure to perform obligations under this Agrcement if such delay or failure results from circumstances outsidc its reasonable control (includ ing, without l imitation, any act of God, governmental action, accident, strike, terrorism, bioterrorism, lock-out or other form of industrial action) and are promptly notified to the other Party ("Farce Majeure").

  • If the consequences of Farce Majeure for the Project are not overcome within 6 weeks after such notification, the transfer of tasks - if any - shall be decided by the Steering Committee and the Programme Operator will be informed in due time.
