Failure or refusal definition

Failure or refusal means a failure or refusal to comply with any notice of violation or order of the chief issued under Chapter 1513. of the Revised Code, except that non-payment of civil penalties assessed against a corporate permittee or non-compliance with any order issued by the chief under section 1513.39 of the Revised Code does not constitute a failure or refusal.

Examples of Failure or refusal in a sentence

  • Failure or refusal of a Transferee to execute any such instrument shall not release or discharge the Transferee from liability as provided herein.

  • Failure or refusal on the part of any employee to comply with this Article shall be cause for immediate dismissal.

  • Failure or refusal by the Grantee to comply with this provision shall be considered a breach of this Grant Agreement, and the State may withhold disbursements to the Grantee or take any other action it deems necessary to protect its interests.

  • Failure or refusal of a Transferee to execute any such consent instrument shall not release or discharge the Transferee from its obligation to do so or from any liability as provided herein.

  • Failure or refusal of Contractor to perform or do any act herein required shall constitute a default.

  • Failure or refusal by the resident to abide by any such directive or procedure may result in disciplinary action or removal by police.

  • Failure or refusal on the part of any employee to comply with the provisions of this Article shall be cause for whatever disciplinary action is deemed necessary by the Board.

  • Failure or refusal by Grantee to comply with this provision shall be considered a breach of this Grant Agreement, and State may withhold disbursements to Grantee or take any other action it deems necessary to protect its interests.

  • Failure or refusal to provide such information is a ground for denial or removal of certification.

  • Failure or refusal by Power Producer to perform any of its material obligations under this Agreement including but not limited to financial closure.
