During the pendency of Supplier’s efforts to develop the Modified Product, Buyer may procure a product in place of the Failed Product from other sources.
In all cases, ▇▇▇▇▇ shall be responsible for returning the Failed Product to Watteam, including all costs associated with the return of the Failed Product.
Failed Product shall not be returned to ASV unless ASV specifically requests such return, and then such product shall be returned at ASV’s sole expense.
