Facility Relocation definition

Facility Relocation has the meaning set forth in Section 5.1(f) of the Master Agreement. Failure has the meaning set forth in the “Acceptance Test Procedures” Exhibit. FCPA has the meaning set forth in Section 10.2(q) of the Master Agreement.
Facility Relocation has the meaning specified in Section 7.02(h).
Facility Relocation. Should Customer request Company to relocate any of its facilities, or take any action which will require Company to relocate its facilities, Customer shall reimburse Company for the costs incurred. Hold Harmless: Company and Customer do respectively assume full responsibility for the maintenance and operation of the facilities owned and/or operated by each, and each shall indemnify and except as hereafter limited, shall hold the other harmless from any loss resulting fi'om bodily injury (including death) or damage of property arising directly or indirectly out of any negligent or willful act or failure to act on file indemnitor's part in the installation, maintenance, operation, replacement and/or removal of the facilities owned and operated by each. Neither party shall be liable to the other in any event, whether in contract, tort or otherwise, for any loss of revenue, profits, use of production, costs of capital or purchased or replacement power, interest, business interruption, claims of customers or any other incidental, indirect or consequential damages of any nature whatsoever. Customer(s) acknowledge(s) the presence of overhead and/or underground power lines and understands that contact with them could cause serious injury or death. South Carolina Public Service Commission: This Contract, the Billing Rate ref'erenced on Page 1, and all services rendered hereunder, are subject to the Company's "General Terms and Conditions" as approved by the Commission, and to the "Rules and Regulations" of the Commission, as the foregoing now exist or may be anaended in the manner prescribed by law. Examples of Facility Relocation in a sentence

  • Any revision by the City of Supporting Documentation provided to the Company that causes the Company to substantially redesign and/or change its plans regarding Company Facility Relocation shall be deemed good cause for a reasonable extension of time to complete the Relocation under this Franchise.

  • Facility Relocation Provisions‌ The needs of a local government, including the need for, or use of, a specific building or facility, may change over time (e.g., a school or government building may be closed or repurposed).

  • In connection with any proposed Facility Relocation or Service Relocation, Provider shall address in writing to Customer the impact of any such move on Customer (including cost and timing of any such move and any potential impact of such move on the Disaster Recovery Services).

  • This incremental charge is billed monthly per retail access line and will be identified on the ▇▇▇▇ as a Facility Relocation Cost Recovery Fee.

  • Provider shall be financially responsible for all additional costs, taxes or expenses resulting from any Provider-initiated Facility Relocation, Service Relocation or relocation to an Alternate Facility (as defined in the applicable Offshore Plan), including any costs or expenses incurred or experienced by Customer Group as a result of such relocation.

  • Customer shall be financially responsible for all additional costs, taxes or expenses resulting from any Customer-initiated Facility Relocation or Service Relocation.

  • Facility means any real property (including all buildings, fixtures or other improvements located thereon) now, hereafter or heretofore owned, leased, operated or used by Holdings or any of its Subsidiaries or any of their respective predecessors or Affiliates.

  • On-site facility means a structural BMP located within the subject property boundary described in the permit application for land development activity.

  • Facility Manager The Authorized User’s representative who is responsible for the day to day operations of the facility(s) referenced in the Project Definition.
